Montserrat Castro

Attorney.


As a member of WAGEMANN | Arbitration, she assists in national and international arbitrations, in cases where the office represents Chilean and foreign companies, with special emphasis on renewable energy and power line projects. Specifically, she supports the office in the preparation of pleadings and documentary analysis.

Additionally, she collaborates with the WAGEMANN | Consulting team in the preparation and elaboration of expert opinions for construction companies located in Chile and abroad.

Prior to joining the firm, she worked as a paralegal in the Litigation and Arbitration Area of the law firm Cariola Diez Pérez-Cotapos, where an important part of her duties involved the processing of cases in the civil courts; replacements in the Court of Appeals and the Supreme Court; support in dealings with various institutions, and the drafting of simple pleadings and administrative office tasks, among others.

Furthermore, she worked as an intern at the Office of Studies and International Relations of the Arbitration and Mediation Center of the Santiago Chamber of Commerce (CCS), where she participated in the research of jurisprudence on arbitration in the Superior Courts of Justice, the study and comparative analysis of doctrine and reports of international commercial arbitration institutions, and the elaboration of statistics and analysis of cases at CAM Santiago. This internship was awarded to Montserrat´s team, after obtaining the first place in the Pre Moot organized by CAM Santiago, prior to the XII edition of the International Arbitration Competition (2019 – 2020).

Her studies at Universidad de Chile were marked by her consistent dedication to arbitration; in addition to taking the Arbitration and Alternative Dispute Resolution (ADR) electives offered by the university, Montserrat participated in numerous international commercial arbitration Moot programs, moving from participant to assistant coach in the team’s training. This experience allowed her not only to develop skills which would be useful for competitions, but also to cultivate professional practices that are normally not learned in academia.

In this regard, her thesis (“Third Party Funding: concepto y viabilidad en Chile”) deals with an innovative and relevant topic, which involves the analysis of the mechanism of financing to plaintiffs, defendants, or their respective lawyers, in order to pay for activities related to litigation by third parties, particularly specialized investment funds.

During her exchange semester at the University of Sydney, Montserrat focused her studies on international arbitration, studying with Professors Vivienne Bath, Dr. Chester Brown, Max Bonnell and Malcolm Holmes KC. During her stay in Australia, she also became interested in learning Mandarin Chinese, a language in which she now communicates at an intermediate level.

Legal advice and representation
  • Representation of a Chilean subsidiary of a French company in an arbitration before the CAM Santiago against a Chinese contractor in connection with a subcontract for the installation of equipment in a high complexity public hospital.
  • Representation of a Spanish subcontractor in multiple arbitrations before the CAM Santiago related to the construction of transmission lines and substations.
  • Advising a multinational wind farm owner in two arbitrations before the CAM Santiago against a Portuguese EPC contractor.
  • Advising a Chilean contractor in an arbitration before the CAM Santiago against a public company in relation to the implementation of a Low Noxx control system in boilers of an oil refinery.

  • Advising a public company engaged in the exploration, production, refining and commercialization of hydrocarbons and their derivatives, in the execution of an EPC contract for the implementation of a Wet Gas Scrubber
