Abstract: Is Covid-19 a force majeure event? Does it give rise to a compensation of the construction costs? Has the economic regime of the concession contracts been altered by the pandemic? Should the State compensate the concessionaires for the costs caused by additional sanitary requirements imposed due to Covid-19? Based on six discrepancies between the State of Chile and concessionaires (of airports and hospitals), the two authors analyse how these questions have been addressed by the Chilean Technical Concessions Panel.
